  1.  Acceptance of Terms

    1. By accessing or using the Tech Again website (“Website”), including purchasing Products, you agree to be bound by these Terms & Conditions (“Terms”).

    2. You must be at least 18 years old, or have parental/guardian consent, to use or purchase from this Website.

    3. By placing an order, you confirm you are legally capable of entering into a binding transaction.

  2. Changes to Terms and Website 

    1. These Terms may be updated at any time without prior notice.

    2. Continued use of the Website constitutes acceptance of any revised Terms.

    3. We may modify or discontinue Website features or Product offerings at any time.

  3.  Accounts, Registration and Security (if applicable)

    1. You are responsible for maintaining the confidentiality of your login details.

    2. You are responsible for all activity under your account.

    3. We may suspend or terminate accounts for: incorrect information, breach of Terms, or suspected fraudulent activity.

  4.  Products, Refurbishment, Condition and Pricing

    1.  We sell refurbished smartphones, tablets, laptops and related accessories (“Products”).

    2. Each Product is tested and confirmed as operational prior to sale.

    3. Products may display cosmetic imperfections consistent with refurbishment.

    4. Product condition grading/descriptions shown on Product pages form part of the sale terms and are deemed accepted at checkout.

    5. Images are for illustrative purposes only and may differ slightly from delivered Product.

    6. Pricing and availability may change without notice.

    7.  Errors (including pricing inaccuracies) may occur; we may cancel orders affected by such errors and refund payments.

    8. Promotions, Discounts and Store Credits

      1. Promotional offers may be subject to additional terms.

      2. Promotions may be withdrawn or modified at any time.

      3. Store credits and discount codes may have expiry dates and usage restrictions.

      4. Orders may be voided if a promotional error occurred.

  5. Orders, Payments and Billing

    1. An order is an offer to purchase. Acceptance occurs only when we confirm dispatch.

    2. You authorise us to charge your selected payment method for the full transaction amount.

    3. We may cancel orders where: Product is unavailable, pricing or listing errors occurred, or we suspect fraud or misuse.

    4. You are responsible for accurate billing and delivery information.

    5. Chargebacks and Fraud Prevention

      1. We may delay fulfilment pending verification where suspicious activity is detected.

      2. If a chargeback is raised without a legitimate basis, you remain liable for: purchase price, bank/processing fees, administrative review cost of $25 per event, and any additional recovery costs.

      3. We may report suspected unlawful conduct to authorities.

  6.  Shipping, Delivery and Risk Transfer

    1. We ship within Australia only.

    2. Delivery times are estimates only and subject to change.

    3. Risk and title pass to you once the order is delivered to the address provided at checkout

    4. Where you authorise “authority to leave,” risk transfers once marked delivered by the courier.

    5. We are not liable for lost or delayed parcels due to incorrect details provided by the customer.

    6. If delivery is delayed or fails due to incorrect delivery information or refusal to accept delivery, any additional delivery, redelivery, storage or return fees are your responsibility.

  7. Warranty, Returns and Consumer Rights

    1. 12-Month Warranty on Refurbished Products

      1. A 12-month warranty applies to hardware/software defects not caused by accidental damage, liquid damage or neglect; modification or unauthorised repairs; physical impact or bending; normal wear and tear (including battery capacity degradation).

      2. Warranty assessment may require you to complete diagnostic steps and return the Product for inspection.

      3. If warranty applies, we may repair, replace, or refund at our discretion.

    2.  30-Day Change-of-Mind Returns

      1. Allowed within 30 days of delivery if: Product is returned in the same condition; no activation/login has occurred; all included accessories & packaging returned.

      2. Customer pays return shipping for change-of-mind returns.

      3. If a return fails to meet criteria, we may return the Product to you at your cost.

    3.  Data and Content on Returned Products

      1. You must securely erase all personal data before return.

      2. We are not responsible for loss or recovery of data on returned Products.

    4.  Return Packaging and Transit Risk for Returns

      1. You are responsible for ensuring that returned Products are packaged securely and appropriately protected during transit.

      2. We are not liable for any loss, damage, or reduction in condition that occurs during return shipment.

      3. If a Product is damaged in transit due to inadequate packaging, the return may be rejected, and you will be responsible for any costs incurred in returning the Product to you.

    5. Battery Health Standard

      1. Refurbished Products may have reduced battery capacity compared to new devices.

      2. Unless otherwise specified on a product listing - A battery capacity of 80% or greater, or a cycle count appropriate to the Product’s age, is considered acceptable and does not constitute a defect or warranty failure.

    6. Account Removal and Device Security Locking

      1. Before returning a Product, you must remove all personal accounts and security locks including, without limitation: Apple ID / Find My iPhone; Google account / Factory Reset Protection.

      2. Failure to remove such locks may invalidate the return or warranty claim, and you may be liable for associated processing and return shipping fees.

    7. Warranty Claim Diagnostics and Proof Requirements

      1. To assess any claim, you must follow all diagnostic steps requested by us including providing: diagnostic screenshots or reports, photographs or videos demonstrating the issue, confirmation of steps taken to troubleshoot.

      2. We may decline or delay a claim if required information is not provided.

    8. Nothing in these Terms excludes or limits any rights or remedies you may have under the Australian Consumer Law that cannot be excluded.

  8.  Acceptable Use

You must not: breach any applicable law; interfere with Website security or functionality; copy, scrape or reverse engineer content; engage in harassment or fraudulent conduct. We may restrict access for any misuse.

  1.  User-Generated Content (Reviews)

    1. By submitting reviews or other content, you grant us a royalty-free licence to use, publish and promote that content.

    2. We may remove content that is misleading, unlawful, offensive or infringes rights.

    3. You warrant the accuracy and legality of content submitted.

  2.  Intellectual Property

    1. All Website content and branding is owned by or licensed to us.

    2. You may view content for personal use only.

    3. Reproduction or commercial use of content is prohibited without written consent.

  3.  Third-Party Links

We are not responsible for third-party websites, content, or services accessed via the Website.

  1.  Data Loss and Security

    1. You are solely responsible for backing up, removing or encrypting personal data on any Product before shipping or returning it.

    2. To the maximum extent permitted by law, we are not liable for any loss, access or recovery of data stored on a Product at any time, including during repair, return or disposal.

  2.  Disclaimers

    1. Except as required under the ACL: Products and Website services are provided “as is” and “as available”; we do not warrant uninterrupted or error-free operation.

    2. Any advice provided is general in nature.

  3.  Limitation of Liability

    1. To the extent permitted by law, we are not liable for indirect, consequential or special loss; loss of profit, revenue, data or enjoyment; delays or delivery issues outside our control.

    2. If liability cannot legally be excluded, our total liability will not exceed the purchase price paid for the relevant Product.

    3. This clause applies subject to the mandatory ACL statement above.

  4.  Indemnity

You indemnify us against claims or losses arising from your breach of these Terms, misuse of the Website, or unlawful conduct. This indemnity continues after termination of these Terms.

  1.  Governing Law

These Terms are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts located in Victoria.
